Well this is what I wrote on Facebook. The first charge to consider is Rosenbaum and there IS technically a problem. Barnes is confident he'll be acquitted and if he is, well, if I could stomach accepting the reality of a verdict I don't like, presumably so can other people. I think he should have gotten the nine months for illegal possession and carry but it was no longer an option.

Since it's never finished and it's never right, I thought I'd just post what's going on in my mind right now after just hearing the defense's very impressive long final statements to the jury, the prosecution's very brief but efficient final response, and looking at the charges as they're written.

This seems to be a very tough call. The problem is once Rosenbaum's hand was off Kyle's gun and he fell--despite his having pursued and threatened to kill Kyle (AND harassing other people, including screaming at someone "Shoot me, N-word", on video, yes that's right, at a BLM protest, Rosenbaum whose hero?, I really do think it was suicide by cop proxy)--once he fell, Rosenbaum had no other weapon and was no threat but Kyle kept shooting, four times total, even though it only lasted a couple of seconds.

And I say all this is a PROBLEM, because no one is claiming any kind of premeditation other than the screaming peanut gallery foaming for 'justice' because he CROSSED STATE LINES WITH A GUN and HE SHOULDN'T HAVE BEEN THERE so that means he's guiiiiiiiiilty and if you question this you're raaaaaacist. He did no such thing, the gun was in Kenosha, this is accepted by the prosecution as established fact, not to mention he practically lived in Kenosha.

On that one, the prosecution was incredibly sleazy because they knew this perfectly well when they called him a (thrill-seeking??) 'tourist' at the very end. He worked there as a lifeguard, his father and grandmother and best friend lived there, his mother's home is 15 minutes away, he was cleaning grafitti there that morning. It disgusts me to have to look beyond that level of sleaze and JUST look at the law. It's very tempting not to.

Oh, right, and he faked the panic attack. (According to you, whoever you are, are you frigging for real?) Kyle WAS offering first aid and putting out fires all night, the rioters WERE destroying property, they WOULD have destroyed more if not for the 2A people like they did the nights before, Wisconsin IS open carry, and Rosenbaum WAS stark raving mad. No Rosenbaum, no nothing would have happened. Ditto for the other two, one killed, one's arm wounded, who should have let him keep running away and just called 911, especially since Grosskreuz is a MEDIC and by then two people were bleeding out. So it IS a problem. This is a tragedy for all involved, and yet I think Kyle may get the reckless homicide. But he won't get the maximum and whatever he does get (assuming there is a conviction), I feel very strongly all sentences should be concurrent.

While I do understand that from a strict 2A perspective, this can and IS being seen as open and shut self-defense, having read the charges and heard the closing comments, I really don't know that the letter of the law gives him this. Clearly we live in two nations now but I exist in the liminal space between, and so yeah, I do, I wish the law as I assume it will be interpreted literally in liberal Kenosha did assure, well, some far lesser conviction. So? Rosenbaum was nuts and Huber with his skateboard and Grosskreuz with his glock were reckless TOO and I simply do not believe, there is no basis to believe, that Kyle ever intended to do anything but help. Cops could have asked him for his ID and seen he was a minor and sent him home. There is a chain of failed responsibility here that goes to all authorities and institutions, including and especially the main stream media during the riots last year, but it is contained in microcosm with this simple question: why wasn't he just sent home? And no, I don't think he wasn't because the cops wanted him to shoot people, I think it was because they were hamstrung in protecting the property. But it was ALSO reckless.

I may be right, I may be wrong about the not improbable conviction, but the difference between me and a lot of other people is that I understand that the outcome isn't about what I wish. It's about the law.
Ironically, about the law in a time of such lawlessness. I also understand that if he gets any long sentence, this will go to appeal and it may very well go all the way to SCOTUS, and that will probably still be Trump's SCOTUS. It was precisely in Wisconsin, in the Midwest, that the Clinton Sellout Democrats gave the Rust Belt, thus the SCOTUS, to Trump by a hair. My friends and me, we watched Friends on Frappacino for two decades while the Rust Belt died. I'm not so sure the majority of my friends would be too thrilled if this did get to that SCOTUS as a 2A self-defense case and the verdict were to be codified there. Masu-kenoja in Ojibwe,as I have said, means place where all the pike come. The annual spawning of the trout of Lake Michigan. What goes around comes around, in cycles. We are both progenitor and spawn. Be careful what you wish for. We are all skateboard.

This is a tragedy all around. If you've actually really followed this case and you can't feel that for Kyle and his family too, imho you need to look at that.
